SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 4 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. SECTION 8 - GOVERNING LAW

These conditions are governed by and interpreted following the laws of the Netherlands, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law in your country to residence. Elaine van der Made and yourself both agree to submit to the non-exclusive jurisdiction of the courts of Utrecht, which means that you may make a claim to defend your consumer protection rights in regards to these Conditions of Use in the Netherlands, or in the EU country in which you reside.

SECTION 9 - USER DATA

We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

SECTION 10 - ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SITE. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

SECTIE 11- Schilderlessen fysiek

  • Aanmelding & betaling
    Je reservering is pas definitief na ontvangst van betaling. Plaatsen worden toegewezen op volgorde van binnenkomst en betaling. Er is een beperkt aantal plekken beschikbaar, dus wees op tijd!

  • Annulering
    Onverhoopt afwezig? Ziek zijn kan altijd. Geef dit minimaal twee uur van te voren aan bij Elaine, dan kun je de les nog inhalen. Ben je later dan twee uur van te voren, dan wordt de les in rekening gebracht  i.v.m. gereserveerde materialen, locatie en catering. Er wordt geen geld teruggestort.
    Wel mag je jouw plek overdragen aan iemand anders. Laat ons dit uiterlijk 2 uur van tevoren weten via e-mail of telefoon. 

  • Les inhalen
    Het is jouw eigen verantwoordelijkheid om gemiste lessen in te halen. Houd zelf het workshop aanbod goed in de gaten en stuur ons een e-mail zodra je een datum hebt gekozen waarop je wilt inhalen. Wij nemen geen contact op om je hieraan te herinneren.

  • Leeftijd
    Deelnemers aan de Paint en Sip avonden dienen minimaal 18 jaar oud te zijn vanwege het schenken van alcohol.

  • Gebruik van materialen
    Alle schildermaterialen worden verzorgd en blijven na afloop eigendom van de organisatie, met uitzondering van jouw eigen schilderij, die neem je natuurlijk mee naar huis!

  • Eigen voorbeeld meenemen
    Je mag een eigen afbeelding of inspiratiebron meenemen om na te schilderen. Zorg voor een goed zichtbaar, printbaar of digitaal beeld (bijvoorbeeld op je telefoon of tablet).

  • Aansprakelijkheid
    We zorgen voor een veilige en prettige omgeving, maar deelname is op eigen risico. Wij zijn niet aansprakelijk voor schade aan persoonlijke eigendommen of kleding. Tip: draag kleding die vies mag worden, schorten zijn op locatie beschikbaar, maar in eigendom van Elaine van der Made

  • Foto’s en sfeerbeelden
    Tijdens de avond kunnen foto's worden gemaakt voor sfeerimpressies op social media. Geef het aan als je liever niet op beeld wilt verschijnen.
